Change of use grass verge

Hi, The council recently refused our householder application to move the fence to the edge of our property boundary to include a strip of land that was out of our garden fence.
They refused it saying that even if the land is ours in "planning terms" this piece of land is not classed as residential but sui generis and we had to apply for a full planning application. However, they also said to not do that since they will refuse it again because they don't want to loose the open verge. Can somebody help us to understand this and if without documents the council can just decide that part of our land is not residential? Thank you

It is common and in the majority of estates, strips of land like you mention help contribute towards the open space and added public amenity. Whether you agree or not is unfortunately not relevant.

If you can find examples of where something similar has been carried out via the formal approval methods, then that will give you something to start with.
