Outdoor Gazebo and Flue

We have installed an outdoor gazebo within 2 metres of our neighbours fences.

We have put a log burner flue through the roof which is 1m. Is this a breach of planning. The guidance states that the total development cannot be over 2.5m, but does this include the flue?

Forgot to say that the height of the roof is 2.4m

The guidance appears to state the whole building so you’d be in breach of PD and would require Planning.

Adding a flue under Class G is usually permitted but that applies to the dwellinghouse and not outbuildings.

The council have reached a decision that:

Under Class G and E of Householder “Permitted Development” Rights, it is deemed that the gazebo inclusive of the flue falls within what is permitted and therefore no further action will be undertaken regarding this matter, which is now considered closed.
