Using an already dropped curb

Just bought a 1950s bungalow on a corner plot.
There are two existing dropped curbs on to the property:
1. at the front of the property (40mph road), with a footpath through the garden to the front door.
2. At the side of the property (20mph road) currently with a long thin impractical driveway.
As part of a planning submission for renovation and small extension, we stated we planned to move driveway to front of property and utilise existing dropped kerb. Getting some pushback though no formal decision yet.
We can’t quite understand the issue here. Would we be within our rights to just use the existing front drop kerb (ie if we hadn’t put in planning for extension) with a porous driveway that doesn’t require planning permission?
Any thoughts welcomed!

Any new application would have to meet and comply with local policies. So if you’re planning or can do anything via PD (which includes a porous driveway), then go for it. Bear in mind it may be beneficial to carry out the PD works prior to the submission or determination of a Full application. Because the last thing you want is for Planning to remove PD rights. You may have to still comply with any Highway/safety issues which is separate to Planning.
