Dining room extension

Extension next door to my mother's property. My mother lives in a semi-detached and her neighbours are having an extension to their dining room. My mother already has a conservatory with windows on the adjoining wall side. The new extension is to be brick which will go beyond her windows. The extension is also going to be further forward that her conservatory. When the extension is built it will cut out her light as she is on the northside of the two semi's. Can she do anything about this. If she did not have a conservatory then her light would be diminished even further because of the brick wall which will be no more than 3 mtrs. What can she do?

John,

If the neighbouring extension is permitted development (i.e. planning permission is not required) unfortunately, there is little control that the planning department can have over the proposal as it meets the laid out criteria.

The right to light is not a planning but civil matter and cannot be controlled through the planning system. It might however be worth having a word with your family solicitor and ask what civil redress may be available.

I hope this helps

John,

I'm afraid theres not much you can do if this is permitted development and Adrian is right the best thing to try is speak with your solicitor and have a look into civil laws.

James
