Principal elevation on L shaped house

Hi - I have been TOLD by my council some time ago that I do not qualify for permitted development. Sadly my wife got ill and so I put the plans to bed.

Now well again we are reviving the plans and with a little research I believe they are incorrect. They told me that I could not build in front of the principal elevation but I believe they drew an imaginary line through part of my house. The house is infact L shaped and I wish to slot the extension in a gap behind both front walls... Can you help clear this up. I have wasted time and money if this is the case. Cheers

Here you go - an image I created of what I THINK the council should have considered the Principal elevation to be.... they drew a line through the property and into the green box (proposed extension.

Initially, I agree with you. Is the footprint of the house as shown original as it stood on 1st July 1948?

In which case the staggered line you have indicated would appear to be correct.

Did you submit a Lawful Development Certificate application and that was refused?

The planner asked me to withdraw it. When I look back his job title had apprentice in it so I think I need to go back and challenge it!

You cannot challenge a withdrawal. You will have to submit another LDC application.

Hi Simon. I would agree with Damian that the line you drew would be the principal elevation line.

One thing to note is that the extension would fall under both side and rear extension rules and would be limited to 4m under PD or 8m via Prior approval (as the property is detached).

As the property was built fairly recently, you may also want to check the original permission to confirm that PD rights weren't removed, as is somewhat common for new builds.
