Summer house on raised ground and within 20m of dirt path

We are about to start a 3m x 5m summer house which our supplier states is within the permitted development rules.

Our garden gradually slopes away from the house until about 3m from the end when there is a sudden drop. At the bottom of the drop stands the fence however when you're on the normal ground of the garden you are actually higher than the 6ft fence. To utilise the garden properly we installed a raised deck right up to the fence in 2007 however planning permission was required as we are within 20m of a "dog walking path" through countryside at the back of the house.

The summerhouse will start on the main ground of the garden and some of the decking will be removed to accomodate the summerhouse and so everything is level. Under permitted development I believe that the height goes from the highest part of the land but the structure will be very visable from the path at the back of the house because it will sit on the raised land.

My question is as to whether the fact the building is within 20m of the back path does that then mean that planning permission will automatically be required?

Providing the outbuilding complies with the requirements as mentioned in Class E, then it would be deemed PD…
